Social Security Disability Considerations for Nursing Assistants and Home Health Care Attendants

Over the past few months, I have represented several health care workers in Social Security disability hearings. The types of jobs my clients have worked include:

-home health care nurses
-nursing home care attendants
-assisted living facility attendants
-licensed practical nurses (LPN)
-senior care attendants

If you have worked in this field, you may have worked in different capacities for multiple agencies or employers. As discussed in this video, I do see some common threads in disability claims filed by health care workers who interact directly with patients.

Many of my clients struggle with low back pain that arises from bending over and trying to move patients who don’t have the strength to help. I see bulging or herniated discs frequently, with pain and weakness radiating into my clients’ legs or arms.

My clients also experience depression - both from living in chronic pain, and because they often feel unappreciated by their patients, who may be unresponsive or terminal.

As the population ages, I expect that home health care or assisted living health care workers will continue to experience both physical and mental health issues. If you find yourself struggling to fulfil your job assignments, remember that you can win Social Security disability but if your medical issues reach a level of severity that you can no longer perform your health care work or any other type of work.
